PRESS RELEASE

AHMADI CHILDREN RELEASED ON BAIL AFTER NEARLY SIX MONTHS IMPRISONMENT

The Ahmadiyya Muslim Jamaat is pleased to announce that the four Ahmadi children and one Ahmadi adult who have been imprisoned for nearly six months, following arrest in District Layyah, Pakistan, have today been granted bail.

Bail was granted by Justice Pervez Inayat, presiding in the Multan High Court, on condition of a fiscal guarantee of Rs200,000 being paid per person.

During the hearing the Superintendant of Police (SP), Mr Sardar Pervez Tareen was called by the presiding Judge to give evidence. The SP made it clear that there was absolutely no evidence connecting any of the accused with the alleged crime.

The five Ahmadis currently remain in jail, however it is expected that they will be released on 9th July 2009.

Press Secretary of the Ahmadiyya Muslim Jamaat, Abid Khan said:
“We are pleased that the five Ahmadis arrested have been granted bail and that they should now be released in a couple of days. All five have conducted themselves in a way that has been a credit to themselves, their families and to the Ahmadiyya Muslim Jamaat.

However these fabricated charges have not been withdrawn and because of this the matter remains of huge concern. It must be hoped that the local prosecutors see sense and bear in mind the evidence of the local SP and drop all charges against the accused. Only then will justice prevail.”

Monthly Newsreport — February, 2009

Monthly Newsreport — February, 2009

Another Ahmadi killed for his faith

Karachi, February 26, 2009: Mr. Mubashir Ahmad of R-99A, Rizwan Society, KDA Scheme No. 33 Karachi was shot to death by opponents of the community on 20th February 2009. He was 42. According to the details, on the day of the incident, Mr. Ahmad was returning home on bicycle on completion of his work in Steel Rolling Mill situated on Mangho Pir Road Karachi. When he reached near a madrassah, two men appeared, fired at him and fled away. He was grievously injured; that resulted in loss of great deal of blood. He was taken to the Abbasi Shaheed Hospital in a critical state, where he died later. He expired before his close relatives could reach him.

He was a harmless and simple man by nature. He had no personal vendetta against anyone. He has left behind a wife and three children. He faced religious prejudice at his workplace for years. He received threats to his life, and faced social boycott off and on. The spokesman of the Ahmadiyya Community said that after the promulgation of Ahmadi-specific laws in 1984, 96 Ahmadis have lost their lives through faith-based attacks. The mulla instigates people to murder Ahmadis, and calls it ‘Jihad’. Among the 96 such murders, this is the 33rd murder in Sindh alone.

Murder attempt on Ahmadi religious teacher

Chak 543, district Vehari; February 25, 2009: Mr. Muhammad Iqbal Abid, an Ahmadi religious teacher was fired at by unknown masked men, when he was waiting for a bus at Adda Faujian Wala in the forenoon of February 25. He received four bullet wounds, but luckily survived.

Mr. Abid had gone to Chak 543 to participate in a community program. He stayed there for the night. The next morning they escorted him to the bus stop, 3 kilometers away from the village. Here the attack took place. The locals are of the opinion that this group could be the same who earlier shot dead an Ahmadi official Mr. Chattha three months ago in the same district. The police inactivity has encouraged them to continue with their deadly attacks.

Mr. Abid was taken to the hospital immediately. He made the statement to the police for the FIR. Later, the community friends moved him to Burewala for further medical care and treatment.

Grenade attack on an Ahmadiyya mosque

Sialkot; February 11, 2009: Some miscreant threw a grenade inside the Ahmadiyya mosque in Sialkot. Fortunately there were only a few worshipers in the mosque at the time as this was not the regular time of a congregational prayer, so only one elderly man was injured. The noise of the explosion spread far. The police arrived and cordoned off the area.

Ahmadis were lucky to get away lightly this time. The attack could have resulted in numerous casualties in different circumstances. Similar attacks on Ahmadis in previous years resulted in loss of many lives and injuries to dozens.

Four innocent Ahmadi children and a man remain incarcerated weeks after falsely accused of Blasphemy

Layyah: Four Ahmadi boys and a man were arrested on 28th January on charge of blasphemy in district Layyah. No witness or testimony exists to support the baseless charge to date but they remain in prison even after four weeks. They were shifted to the D.G. Khan Jail on 4th February. Their near relatives were not allowed to meet them for some days. The investigating team of Human Rights Commission of Pakistan (HRCP) was also not allowed by authorities to interview them. According to the report of the Frontier Post of February 8:

Four Ahmadi children charged with blasphemy have been sent to Dera Ghazi Khan Central Jail, Houses of the Qadiani community are besieged

The Superintendent of Police (Investigation) Layyah, Pervez Tareen told the Frontier Post: “I have sent the children on judicial remand and would continue with the investigation.” However, he said that he could not give a time-frame for the conclusion of the investigation.

The police remand submitted to the civil court states that the investigation has not been completed, however the accused should be sent to jail. The local community head told the press reporter that the police had deliberately delayed the investigation, while it had already admitted lack of evidence against the accused. He said that they had provided books to the children in the prison so that they could prepare for their final examinations to be held shortly. He stated that the police had not taken any action against the local chapters of the banned organizations. These are deeply involved in instigating the recent unrest. It is learnt that local MNA PML (N) Mr. Saqlain Shah is backing the extremist elements in the area against the Ahmadis. Daily Times issued a report on February 17, 2009:
A Pakistan Muslim League-Nawaz (PML-N) member of National Assembly from Layyah has instigated the local people to observe a protest today (Tuesday) against four teenagers and a man belonging to the Ahmadiyya community arrested on the charges of blasphemy, a rights body said on Monday. The accused will be brought before a court today. A press release issued on Monday by the Asian Human Rights Commission (AHRC) stated that some radical groups had announced a show of strength against Ahmadis to pressurize the court not to grant bail to the five Ahmadis. HRCP issued a fact-finding report which was published in Daily Times of February 13, 2009. It mentions: The HRCP team found that elements belonging to banned extremist organizations and that a relative of a member of National Assembly (MNA) from the area had pressured the police to register a case.
These children are being kept in unacceptable and inhuman conditions, while they are innocent, and the charges against them are false. They have been incarcerated for more than a month. They are suffering at the hands of extremists while the Punjab Government decided to be soft against the agitators and harsh on the innocent. They have learnt no lesson from Swat, Bajaur and Waziristan. Now they are committing the same mistake in the Punjab; the depth of their imprudence is unfathomable.

Attacks in Peshawar

Peshawar; February 7, 2009: Mr. Muhammad Ayaz, a 20-years old son of a former President of the district Ahmadiyya community became the target of an attack by unknown attackers. They shot him in the legs. His condition is now stable.

The same day an Ahmadi youth, son of Dr. Muhammad Nasim Khan escaped an abduction attempt with great difficulty. Three bearded men who were riding a car had attempted to grab him.

The two incidents in one day caused great concern to the Ahmadis of Peshawar.

Rocket attack on an industrial plant owned by Ahmadi

Mandi Bahauddin; Shah Taj Sugar Mills at Mandi Bahauddin is a major industrial unit in the district. Its owner is an Ahmadiyya business family. It provides jobs to hundreds of people on the plant; it buys cane from farming families whose members are in thousands. Some criminals, most likely under religious motivation, attempted a rocket attack on its main production plant. Anti-Ahmadi extremists have always openly mentioned this industry’s proprietors in their public list to be the target of a boycott.

Apparently the rockets were fired from a distance of approximately one kilometer. Three of these fell within the parameters of the mills and exploded, while the fourth failed to explode. It appears that they had targeted the main boiler. Had one of these rockets found its target the explosion of the boiler would have resulted in extensive loss of life. The police registered the case and are investigating.

This is a major escalation in anti-Ahmadiyya violence.

Ahmadis under threat all over the Punjab

Lahore; February 18, 2009: The Daily Express, Lahore in its issue of February 18, 2009 reported the following:
Danger of attack on 365 religious centers of Qadianis in Punjab.
43 business enterprises could also be targeted. Orders for strict security.
Bahawalpur (Express Reporter): Investigation Branch of the Punjab has issued a letter to all the RPOs, CPOs and DPOs of the province in which it is said that according to intelligence reports terrorists are planning to attack 365 religious centers of Qadianis in the province. There are 69 such centers in Jhang. Sargodha 54, Faisalabad 28, Sialkot 22, Gujrat 21, Gujranwala 18, Rawalpindi 11, Lahore 10, Toba Tek Singh 10, and some more in other cities. There are 43 major business enterprises and Qadiani companies in the province. Therefore, strict security measures for their places of worship and business enterprises should be taken immediately.
Denial of promotion to an Ahmadi for his faith
Lahore High Court declares it illegal

Lahore: The daily The News International of February 15, 2009 reported the case of an Ahmadi in government service, whose department denied him career advancement on account of his faith. The text of the report is produced below. Although the discrimination to which the Ahmadi was exposed is not expressly stated in detail, the report is indicative of the prejudice and partiality suffered by Ahmadis in public service. The news report:
Denial of promotion on basis of religion illegal: LHC

Justice Mian Saqib Nisar of the Lahore High Court on Saturday accepted the petition of Shaukat Ali Wahla of the Sargodha Auqaf Department and declared as illegal the recalling of his promotion as an officer on the basis of being an Ahmadi.
The petitioner was promoted as superintendent in BPS-16 and his promotion was subsequently recalled on August 6, 1996, on the grounds that the Punjab Waqf Properties Ordinance did not permit promotion of a non-Muslim as an officer.
Wahla challenged the order before the high court, which held that the petitioner was condemned unheard. After disposal of the petition, the department recalled the impugned order.
Later, the Auqaf department allowed the petitioner move over on May 21, 2001, from BS-16 to 17, granting him selection grade on the same date. But again on October 10, 2001, he was issued a notice that his promotion as superintendent was illegal and it was recalled on January 29, 2002.
Wahla again challenged the order before the high court, which accepted his petition on October 13, 2004, and held that discrimination on the basis of religion was against Article 27(1) of the Constitution.
The Auqaf department challenged the order before the Supreme Court of Pakistan, which remanded the case to the high court on October 12, 2006. The case came up for hearing before Justice Saqib Nisar who declared that the recalling order as illegal.

Denial of appropriate final rites to an Ahmadi dead

Moro, District Naushero Feroz (Sindh): Mr. Nasir Khan, an Ahmadi elder died in his village in the first week of February. He was a practicing Ahmadi. Some of his children are Ahmadis while some are not. At the occasion of his death, the local mulla created a great deal of fuss and imposed a ban on Ahmadis to give him an Ahmadiyya burial.

The deceased’s Ahmadi sons and friends were told that they were not permitted to offer his funeral prayers, nor were they allowed to participate in his burial. The mulla threatened violence if his dictate was not followed.

Ahmadis decided to forego their rights and stay well clear of the mischief. However, it is a pity that Ahmadi children of an Ahmadi dead could not give him an Ahmadiyya burial. The mulla’s will prevails as the state leaves him unbridled.

All Ahmadi teachers fired

Lahore: For the last few weeks the Principal and management of Qurban High School are facing drummed up charges of Blasphemy by the mulla. In the meantime, one of the Ahmadi teachers of this school died. As she was greatly respected for her teaching, her coffin was brought to the school for farewell respects. This infuriated the mulla further and he beat the war drums louder.

The mulla added a few more demands and threats to his list. The school administration, already under pressure, conceded to fire all the Ahmadi teachers working in the school.

With little support from the authorities, the society is in a state of siege at the hands of clerics. The authorities fail to realize that continuous hold on power cannot be realized by bowing down to injustice. Mr. Shahbaz Sharif lost his chief ministership on February 25.

Boycott of business

Karachi: Asko Bakery is an Ahmadiyya outlet in Karachi. It has three branches. They provide satisfactory service and produce quality products.

Unknown individual or some unknown organization has moved to harm the Asko Bakery by appealing to sectarian prejudice and sentiment. They issued a printed pamphlet that contained anti-Ahmadiyya slander and provocative jargon to dissuade customers from buying Asko products. The pamphlet contained the following inter alia:
  • Qadianis are worst enemies of the faith and Islam.
  • They commit blasphemy against prophets, especially the Holy Prophet (p.b.u.h).
  • They consider Mirza Ghulam Ahmad Qadiani as their prophet.
  • They spend their earning on preaching Qadianism.
  • So do not buy their products and sell your faith in lieu.
  • Asko Bakers is a Qadiani business. They have their branches in the same street and Sindh Lab, and also in Chhota Bahadurabad.
A noteworthy circular

Rabwah: Director of Public Affairs (Nazir Amur Aama) of the Sadr Anjuman Ahmadiyya Rabwah issued a letter for information of all concerned, on the latest communal drive and agitation against Ahmadis in Pakistan, and the conspiracy behind it. Its English translation is produced below.

Sir,

Salutation

We hope that all is well with you.

World Tahaffuz-e-Khatme Nabuwwat published the attached calendar for year 2009 (not attached here) which carries provocative writings against Ahmadis. It carries a slogan: The only cure for Qadianis: Al Jihad Al Jihad. It motivates general public to undertake murder of Ahmadis. Also, Markaz Sarajia Lahore is systematically distributing several hate-promoting pamphlets against Ahmadis throughout the country. Photocopies of the titles of some of these are attached.

Recent attacks on Ahmadis and hostile activities against them is the result of a conspiracy of these sectarian elements and social anarchists who promote murder and violence in the name of religion and play pivotal role in provoking communal hatred in the society.

It is unfortunate that in this critical situation the negative role for print and electronic media is encouraging the extremist elements. However, decent people look down upon these savage developments. These extremist and terrorist elements undertake violence against a harmless group in the name of religion; thereby they harm the country. This kind of literature plays an important role in this regard.

Since 1984 when Ahmadi-specific laws were enforced, 95 Ahmadis have fallen victim to religious hatred and extremism. Edicts of Ahmadis; murder are routinely issued. Such murders and murder attempts continue in the New Year.

Despite prohibition, the publication of the attached provocative literature that promotes violence calls for appropriate action by authorities without further delay.

Sincerely,

Saleem uddin
Director of Public Affairs
Rabwah (Chenab Nagar) District Jhang

Ahmadis' human rights and the national Urdu press

Rabwah: The Press Section of the Sadr Anjuman Ahmadiyya issued this month its annual report (2008) on “Anti-Ahmadiyya news published by the Urdu newspapers”. It gives facts and figures, and makes interesting reading.

The survey was restricted to only the major Urdu national dailies. During the year 2008, it remained a routine with the Urdu papers to print anti-Ahmadiyya statements and hatepromoting news in bold headlines. However, no paper had the courage to print the occasional Ahmadiyya explanation conspicuously. In year 2007, nine hundred and seventy four such news items appeared in the press, but in 2008 it went up to one thousand and thirty three items. Almost all of these were prejudiced, hate-promoting and false propaganda. The daily Nawa-i-Waqt (Editor: Majeed Nizami) led this band by printing 465 news, while in 2007 it printed 235 news against Ahmadiyyat. The daily Jang stood second (founded by Mir Khalil ur Rehman), and the Daily Express was at close third.

Mullas are in the habit of making provocative statements. These are published without any verification. As a result, common folk get agitated and inflict physical and costly harm upon Ahmadis. As a result of such provocation and hateful propaganda six Ahmadis were murdered last year for their faith.

A few of these headlines whose photocopies have been printed in that report are translated below for the information of our readers:

  • Qadianis are not loyal to the country, nation and Islam. — Sajid Mir
The daily Jang, Lahore; May 27, 2008
  • Qadianis are enemies of Islam and Pakistan. — Shadabi Raza, Mufti M. Sadeeq
The Daily Express, Lahore; June 2, 2008
  • Our drive will continue till the end of Qadianiat. — (Aalami Khatme-e-Nabuwwat Conference)
The daily Pakistan, Lahore; September 9, 2008
  • The centenary celebration of Qadianiat is a conspiracy to destroy the peace of the country - Ulema
    The daily Nawa-i-Waqt, Lahore; May 24, 2008
  • Qadianis are involved in the publication of blasphemous cartoons. — Abu Bakr Madni
The Daily Express, Lahore; April 17, 2008
  • Cases should be registered against Qadiani students of the PMC
    The daily Nawa-i-Waqt, Lahore; June 30, 2008
  • 600 Qadianis of Pakistan recruited in Israeli Army
    The daily Nawa-i-Waqt, Lahore; October 16, 2008
And many more.

Communal tension in the National Textile University - Faisalabad

Faisalabad: Campaign is going on against Ahmadis in the National Textile University Faisalabad for the last few months. It includes distribution of sectarian literature, hate speeches by mullas in the university mosque, and posting provocative stickers. They held a conference in the university mosque on 17th February, 2009 after the evening prayer. Four hundred students were among the participants. The mullas made abusive and slanderous speeches against Ahmadis. As a result of this conference an environment of hate and prejudice prevails in the University. Two Ahmadis male students and three female students had to be shifted outside the hostel. Subsequent to this an Ahmadi delegation met the Superintendent of Police (Operations) of Faisalabad and conveyed him all this information and their concern, in writing. Audio recordings of speeches and copies of the distributed literature were also provided to the official. He promised to look into the case. Subsequently Ahmadi students were shifted back to the hostel on 22nd February, 2009. They are facing a social boycott there, but the situation is under control apparently.

Faisalabad is the same city where in June last year, the management of the Punjab Medical College committed the grave wrong of expulsion of all their Ahmadi students from the college and the hostel. It took months to pacify the situation and reverse the wicked and unjust action.

Corruption in the Town Council of Rabwah

Rabwah: The daily Ausaf of February 25, 2009 published a news item regarding the Rabwah town council which was sent in by its ‘Special Representative.’ Its English translation is produced below:
Chenab Nagar: The office of Town Council Chenab Nagar has become a centre of corruption. Fraud of millions in official records.
Millions of rupees drawn fraudulently from the treasury causing heavy losses.
Employees have occupied residential plots worth billions.
They have filled their pockets in the name of taxes and ‘Plans Approval.’

Chenab Nagar (Special Reporter): The Town Council of Chenab Nagar has become a house of corruption; alleged fraud of billions of rupees disclosed. Ch. Ahmad Yousuf, well-known literary and social activist of the town claimed this in his letters sent to the Chief Minister, the Secretary Local Government, the Commissioner Faisalabad and the DCO Jhang Mr. Asad Islam Mahni. As per details, he disclosed, along with proofs, corruption amounting to millions of rupees in official records in collaboration with Azmat Qadeer Waiya of TMA Chiniot. He asserted that the employees of the 4th grade up to high ranks are indulging in unrestricted loot of citizens. Consequently the treasury has suffered a loss of millions through official irregularities and rackets. Ch. Ahmad Yousuf exposed the bogus receipt books used in this fraud. Employees of the council have illegally occupied plots worth billions of rupees. Ninety percent of the commercial plots in Chenab Nagar have been converted from residential with collaboration of the Council officials and employees. The staff has filled their pockets by blackmailing the citizens in the name of ‘plans approval’ fees and other taxes. Ch. Ahmad Yousuf has demanded immediate action from the higher authorities.
Ahmadis behind bars
  1. Mr. Muhammad Iqbal was imprisoned for life in a fabricated case of blasphemy. He was arrested in March 2004, and is now incarcerated in the Central Jail, Faisalabad. An appeal lies with the Lahore High Court against the decision of the Sessions Court. It is registered as Criminal Appeal No. 89/2005. He is now in the sixth year of his imprisonment.
  2. Three Ahmadis namely Messrs, Basharat, Nasir Ahmad and Muhammad Idrees along with 7 others of Chak Sikandar were arrested in September 2003 on a false charge of murder of a cleric, alleged by opponents of the Jamaat. The police, after due investigation found no evidence against the accused. Yet these men still faced ‘complaint trial’ for a crime they did not commit. Based on the unreliable testimony of the two alleged eye-witnesses (who were proven false in the court) the court acquitted seven of the accused, but on the evidence of the same two liars the court sentenced these three innocent Ahmadis to death. They are being held in a death cell at a prison in Jehlum, while their appeal lies with the Lahore High Court. These innocent are now in the sixth year of their incarceration. Their appeal to the Lahore High Court is registered as Criminal Appeal No. 616/2005 dated 26 April 2005.
  3. Dr. Muhammad Asghar was arrested on a fabricated charge of blasphemy. The judge rejected his plea for bail. The police investigation found him innocent.
  4. Rana Khalil Ahmad, an elderly and disabled gentleman, is detained for allegedly writing a letter to a cleric.
  5. Mr. Rashid Iqbal is facing a fabricated accusation under the blasphemy law. He was arrested and refused release on bail.
  6. Four school-going children and Mr. Mubashir Ahmad were charged in Layyah for blasphemy on 28th January, 2009 and put behind bars without any initial inquiry or witnesses.

In 2004, an amendment was made in Criminal procedural Code (CPC) Section 295C of the constitution according to which the police is bound to thoroughly investigate blasphemy accusations before leveling criminal charges. The aim of the amendment was to reduce the scope of blasphemy laws which are still widely and frequently abused and often result in death penalties. But this did not happen in this case (of Ahmadis in Layyah).

Monthly Newsreport - Ahmadiyya Persecution in Pakistan - January, 2009

--- Ahmadiyya Muslim Community, Pakistan

An Ahmadi is shot dead for his faith

Kotri, Sindh; January 19, 2009: Mr. Saeed Ahmad was assassinated by unknown persons at Kotri on January 19, 2009. He was fifty five. He had no personal enmity with anyone. He returned home one evening from his job. At the entrance of his house, a man standing nearby shot him in the head. The attacker fled after the attack. Mr. Ahmad died on the spot. An FIR was recorded against unknown persons, but no arrest has yet been made.

He was a pious man who was at peace with himself and his environment. He had a wife and four children. Three of his children are college-going. This family migrated from Sakrand to Kotri in 1990. He was buried in the Ahmadiyya graveyard in Kot Gondal, District Hyderabad.

Kotri was the scene of intensive anti-Ahmadiyya sectarian agitation during last year. The police and the judiciary acted with hostility towards Ahmadis, and failed to provide them with protection. The present murder is the latest attack in the same context. The administration and the police have to share the responsibility for the loss of this innocent life. One could see it coming for months. Chapter 4 of last year’s Annual Report may be seen for the sectarian incidents at Kotri during 2008.

Four Ahmadi school children and an adult frivolously booked and arrested by the police on false accusation of Blasphemy by extremist elements
The applied clause PPC 295-C carries death penalty

Kot Sultan, District Layyah (Punjab): The police charged four school-going Ahmadi children aged 14 – 19 and an adult on a false charge of blasphemy, under section PPC 295-C on January 28, 2009 with FIR 46/09 at police station Kot Sultan. The accused children are Muhammad Irfan, Tahir Imran, Tahir Mahmud and Naseeb Ahmad. Mr. Mubashir Ahmad, an adult is also on the list of accused. Although the complaint was made by one, Liaquat Ali, the fabricated accusation was pushed by Shahbaz, a school teacher, and one N.E. Kulachi who belongs to the religious group Jamaat-ud-Daawa, banned recently by the UN for promoting terrorism.

The police arrested the accused without establishing a prima facie case. They charged them without evidence and before any investigation. The applied blasphemy clause carries the death penalty.

According to the accusation, graffiti defiling the name of the Holy Prophet (PBUH) was found on the toilet walls of a local mosque. It must have been undertaken by the four boys under instructions from Mr. Mubashir Ahmad, speculated the accuser. The complainant has provided no evidence. In fact, the accusation is false and smacks of conspiracy. The police will do well to look for the blasphemer among the group that is making the most noise.

The Daily Times of January 30, 2009 reported: “Saqlain Shah, an MNA from Pakistan Muslim League Nawaz, denied his uncle had pressured police. But he said representatives of the Ahmadiyya community should have visited his uncle’s residence for the matter to be resolved in line with local traditions, instead of denying the charges. He also said that Ahmadis had first lodged cases against local Muslims (for violating the Loud Speakers Act and under the Maintenance of Public Order) after not being allowed to hold a religious meeting, and should now ‘face the truth’.” Although what the MNA said is opprobrious, it manifestly shows the political support the accusers have and the warlord attitude to an issue which is essentially one of law and order.

According to the relevant law, an officer of the rank of superintendent of police is required to investigate blasphemy cases. As this law was deliberately worded to make it ineffective, it provides no relief to those falsely accused, as has happened in this case, and often before. This law is essentially mala fide like the blasphemy law. It is a hoax.

According to the latest reports, the mulla, despite the arrests, has continued to make threatening speeches, distribute leaflets and instigate the masses. Large processions have been taken out and loot is attempted. Ahmadis had to shift their women and children to safer locations, but their men stayed at home to ensure self-defence. They are also facing a social boycott.

For weeks in the recent past, the anti-Ahmadiyya lobby had been fermenting agitation. In the blasphemy accusation they have found a convenient weapon with which to strike. Simultaneously, they have threatened bloodshed, arson and processions. This has provided an excuse to the police to register the case and make immediate arrests. It makes no sense that the police arrest innocent persons to forestall a threat to law and order. This amounts to playing in the hands of religious extremists.

Inspector Khalid Rauf told AHRC (Asian Human Rights Commission) that “the gravity of the case against Islam justified arresting the children first. He said the police do not know of any substantial evidence that links the four students with the crime.” Unbelievable but true, that no police official saw what, if anything, defiling was written on the toilet walls. According to the AHRC “Family members were told (by the district police officer) that the police were under pressure from the fundamentalists to act against the children.”

The BBC reports that according to the police no one saw the named boys writing the (blasphemous) words. “Human Rights Commission of Pakistan (was) alarmed over four children’s detention on blasphemy charges”, reported the Daily Times, Lahore of January 30, 2009. “Victimizing children with false accusations is the most condemnable use of the blasphemy law”, said the Ahmadiyya community spokesman. The AHRC urged “the government of President Asif Zardari to immediately release the illegally detained prisoners. Instead they should turn their attention to the dependence of Punjab Police on fundamentalist Islamic groups and the implementation of the rule of law in the province …”

On February 3, an HRCP team visited Layyah to investigate. It noted that “the circumstantial evidence prima facie failed to prove the allegation against five people.” The team observed that “even in the FIR there is only suspicion of the involvement of the accused in the crime.” The HRCP team found five Ahmadi families consisting of around 40 people ‘in utter fear’. The wife of the accused man told the HRCP team that a local shopkeeper refused to sell her grocery and told her not to visit his shop because he feared that this might put his life and property at risk. District Police Officer Muhammad Azam did not meet the HRCP team. He also did not allow the team to interview the accused. (The daily Dawn, Lahore; February 4, 2009) The children have been shifted away to Dera Ghazi Khan prison where they have been lodged separate from their Ahmadi senior. No Ahmadi was allowed to visit them.

It is learnt that Mr. Sarwat Nadeem, a provincial minister in Baluchistan came over and met the local MNA Mr. Saqlain Shah who is unsympathetic to the plight of the accused.

The Daily Times of January 30, 2009 quoted religious scholar Javed Ghamdi as, “the children were safer in police custody.” The learned scholar should consider that there are other ways available to the state to protect innocent children than arrest them on charges that carry the death penalty. The police action seriously violates Article 37 of the UN Convention on the Rights of the Child.

Hundreds of Ahmadis have faced charges and accusations under the blasphemy laws and many have suffered in prisons for years. One of them, Muhammad Iqbal is now undergoing a life sentence in Faisalabad prison, although he is innocent. This is his fifth year in prison. A few months ago, a venerable old Ahmadi Dr Asghar was booked on a false accusation of blasphemy, and was arrested. The lower courts denied him release on bail. A few days ago a high court judge also rejected his plea for bail, observing reportedly, “We shall provide no relief to those who defile the names of great divines.” This observation by the judge based on presumption of guilt of the accused was unbecoming and callous. The gentleman remains behind bars and has to go to the Supreme Court to get relief against the fabricated charge.

The state should pay heed that it is this kind of handling that has led to near loss of government writ in Swat. Submission to clerics and poor governance are no answer to social and communal problems.

If the government is serious about fighting the evil of terrorism and sectarianism, it must take effective action against religious extremists by at least withdrawing support to them in the use of the blasphemy law, a convenient tool available to them. As a first step, the state should immediately withdraw all the false blasphemy charges against those accused in all cases, to make its declared policy credible.

An Ahmadi, facing fabricated charge of blasphemy is denied release on bail at the High Court level

Lahore, January 19, 2009: Justice Rana Zahid Mahmud of Lahore High Court rejected the bail application of Dr Asghar an elderly Ahmadi falsely accused of blasphemy. “We shall provide no relief to those who defile the names of great divines,” observed the judge (the daily Pakistan of January 20, 2009). This observation of the judge was improper as the trial has yet to start. The accused now has to approach the Supreme Court to seek well-deserved relief. The backdrop of this case is worth mentioning.

In June last year, agitators of the Khatme Nabuwwat organization put up defamatory posters on a wall in Nankana Sadar. Someone tore one of these off and the group rushed to the police to lodge a complaint against 16 Ahmadis for Blasphemy. Of these, six were named and 10 anonymous in FIR 351/08. The police registered the case, raided Ahmadi homes and detained individuals. One of those arrested was an elderly gentleman, Dr. Asghar Abdul Rahman. They held him as the prime suspect and interrogated him for days. Eventually, by 10th September 2008, the investigation was complete, and the police concluded that the doctor was not the one who tore down the poster.

On September 11, Muhammad Malik, the complainant in the above case was on his way back from the mosque after the evening prayers (Isha) when two men on a motor-cycle overtook him, and shot him dead.

Boota, the father of Malik, in consultation with his advisors, approached the police and had an FIR registered in which he named two Ahmadis as the murderers and two of their non-Ahmadi friends as helpers in the attack. He mentioned in the complaint that Ahmadis killed his son because he was the complainant in the Blasphemy case, and as such instrumental in the arrest of Dr Asghar. Mr. Tahir Nadeem, one of the Ahmadis accused was a son of Dr Asghar while Mr. Rashid the other accused was the doctor’s nephew. Rather than releasing Dr Asghar whom they had found innocent of the alleged blasphemy, they arrested his son and nephew also. They also arrested the third person, while the fourth went into hiding from fear of the police. But this was not the end of the matter.

A few weeks later, police investigators located the actual killers and arrested one of them. He confessed the murder and informed the police of others who were involved. The police thereafter released all the Ahmadis who were detained as suspects. However, they retained Dr Asghar in the blasphemy case, equally false, as a lower court denied bail to the innocent doctor. Several attempts for the bail of Dr. Asghar were made in Sessions Court but they were of no avail. Eventually eight months after his arrest when the High Court was approached for relief, Justice Rana Zahid Mahmud rejected the justified plea for bail. He acted more like a mulla than a judge.

It is appropriate to mention here a statement of the Pakistani ambassador to the United States, Mr. Hussain Haqani, at the occasion of the inauguration of the new US President: The United States should come forward to support the people of Pakistan in their dream of making Pakistan a strong and stable democracy, economically vibrant – country where human rights and dignity are respected.

Attack and abduction attempt against an Ahmadi doctor

A gang of armed men tried to abduct an Ahmadi doctor Mr. Mansoor Ahmad at Bazid Khail, Peshawar on January 19, 2009. He was at his clinic when they arrived. They came in three vehicles. All of them were wearing long shalwar kameez and were wrapped in sheets. They had long hair and beards and looked like the Taliban of the Afridi clan. They grabbed the doctor and dragged him to their car. In the scuffle they injured him by hitting him on his head with a Kalashnikov butt. The doctor’s brother received news of this and fired on the attackers from his house that is adjacent to the clinic. The ensuing firefight injured two of them. One of them fell down on the ground. The abductors let go Mr. Mansoor Ahmad and helped their colleague. They succeeded in making their escape along with their injured companions.

Dr. Mansoor Ahmad had six stitches in his head, and was discharged from the hospital.

His cousin who works in the clinic received a bullet injury in his back and was hospitalized.

Mr. Farhan Khan, who owns a plumbing shop next to the clinic tried to help the doctor during the raid. He was shot dead by the attackers. He was 35 years old and had 6 children.

Mr. Mansoor Ahmad’s is the only strong Ahmadi family in Bazid Khail. The attack has not destabilized them, and their moral is high. The local authorities have provided some security to the family by posting a few policemen who have built a bunker in front of Mr. Mansoor’s house.

The locals also protested against this attempt.

Threat to a community office-bearer

Haripur (NWFP): Mr. Zulfiquar Ahmad, the District Amir of Haripur, Hazara received a threatening letter this month. It conveyed that:
You people indulge in anti-Islam activities. This results in people distancing themselves from Islam. If you care for your life, children and property, pay up five million immediately. Close down the Noor Mosque. Stop misguiding the people. This should be undertaken within 10 days. Two of our men Maulvis Mansur and Fazal Jan will wait for you and the money at Camp No.12. If you do not comply, you will be our guest.
After due consultation, the Amir decided to close down the Ahmadiyya Center and shift his residence temporarily.

An un-nerving burial problem

Chak 287/GB, District Toba Tek Singh: Mr. Shah’s Ahmadi daughter-in-law expired on January 5, 2009. He had a grave dug up for her burial in the graveyard that is in common use of locals since 1876. During the night, instigated by some seniors, a few people refilled the empty grave with earth. The next day, the village elders refused to help, so Ahmadis went to the District headquarters where the DCO did not bother to read their application, instead directed them to see the DPO (District Police Officer). When they contacted his office, they were told by the clerk that the DPO was aware of the problem, but was not in a position to help. So the delegation returned to the village and buried the girl in their farm.

A few days later another Ahmadi died in the same village. His wife and children are not Ahmadis. The mulla announced that Ahmadis may not offer his funeral prayers, see the dead man’s face at the occasion of last rites, and participate in his burial. In the evening they conveyed a threat to Ahmadis that they will dig out all the dead Ahmadis from the graveyard. This disturbed Ahmadis greatly. They wrote applications to the authorities. At this the mulla calmed down a bit and directed his flock not to indulge in any disinterment. Some of the locals sympathized with Ahmadis because of this despicable behavior.

No drinking water for residents of Rabwah

Rabwah: The daily Aman, Faisalabad of January 4, 2009 published a story on the plight of residents of Rabwah, and gave the following headlines.
  • The residents of Chenab Nagar are deprived of clean drinking water for the last one month.
  • People are wandering about carrying vessels in search of water.
  • Thirsty children recorded their protest in front of the office of Chief Officer but he did not care. No plumber is appointed in Chenab Nagar.
  • TMA Chiniot has enrolled a plumber and half a dozen staff for water works in Chenab Nagar. The tube-well supervisors are also working in Chiniot instead of Chenab Nagar.
  • Substandard water pipes are now worn out, hundreds of millions (sic) of water is being wasted in the nearby fields and the incompetent technical staff is unable to do repairs.
Blasting out stone continues in the ‘Red Area’ of Rabwah hills

The daily Jang of January 13, 2009 published the following report regarding the digging out of stone from the declared ‘Red Area’ of Chenab Nagar and the consequent plight of the people.
Chenab Nagar (Staff Reporter): Stone blasting continues even after the authorities have declared this area as the ‘Red Area’. Many houses in Muhallah Darul Yuman have been damaged as heavy flying stones struck them as a result of blasting. Walls of many houses collapsed and a number of people lost their lives. Many have been rendered disabled and many a mountain laborers have died. Despite all this, illegal blasting goes on blatantly. It is noteworthy that this digging of stones continues despite declaration of these hills as ‘Red Area’ by the Department of Minerals.

Prejudice beyond limits

An Ahmadi teacher of a private school ‘Qurban High School’ in Lahore died. She was a popular teacher in the school. Her coffin was brought to the school for last respects, and later she was buried with due honour. This reverence rankled with some sectarian teachers. They, assisted by a mulla, told the principal who is also the owner of the school to read out a statement in an assembly of students. This statement contained slander and used abusive language against the Ahmadiyya community and its founder. The Principal refused to comply. At this, some rowdies attacked the school office and damaged its furniture and fittings. Ahmadi teachers and the principal had to be rescued from the trouble spot.

Ulama banned in districts

January 2009: District administrations issued orders imposing ban on entry of specified ulama to their respective districts. This action was taken as a preventive measure to ensure law and order in the districts during the month of Muharram. The listed ulama are generally those fire brands who incite their flock to violence, or they are known to provoke the other sects through slander and even vulgarity. These lists of the banned cleric are published in the daily newspapers. Here we reproduce only the headlines from some newspapers, leaving out the namelists:
36 ulama banned in Jhang
The Nation, Lahore; January 2, 2009
58 Ulema banned in Attock
The Frontier Post; January 1, 2009
Ban on the entry of 8 ulema in Islamabad. Section 144 imposed to avoid terrorist and suicidal attacks
The Aman, Lahore; January 4, 2009
437 Ulama forbidden to enter various districts in the Punjab. 15,000 security personnel posted in Lahore for Muharram duty.
The daily Jang, Lahore; January 6, 2009
Maulana Allah Yar Arshad banned to enter Sindh for one month
The Pakistan, Lahore; January 7, 2009
etc. etc
The last entry deserves comment. Mulla Arshad is posted permanently in Rabwah by his parent organization. His duty is to foment sectarian strife in the town and the area, and he is quite competent in this. The fact that the government of Sindh has decided to keep him out, is indicative of the harm and mischief that this cleric is capable of generating. Rabwah had to tolerate this intruder for years. There is a reliable story that General Zia had given him a chit that the Maulana was his friend and was to be provided all assistance (by concerned officials).

A close reading of these lists of the banned ulama shows that most of these clerics (non-Shias) are those who often come to Rabwah to address anti-Ahmadiyya conferences. It is illogical for the authorities to ban them during Muharram, and facilitate their visit to Rabwah — although their threat and risk to society’s peace is the same. Mullas that are mentioned ‘in dispatches’ are: Muhammad Ahmed Qadri, Masood Azhar, Ali Sher Hyderi, Khadim Hussain Dhalon, Alam Tariq, Muhammad Ahmad Ludhianwi, Akram Toofani, Allah Yar Arshad, Muhammad Ishaq etc.

Agitation in academic institution

Mirpur Khas: There is a Government Elementary College (Men) at Mirpur Khas, Sindh. It appears that sectarian and extremists elements have tightened their grip over this institution. The principal of the college is an Ahmadi. The murder of Dr Abdul Mannan Siddiqui, the president of the District Ahmadiyya Community has provided an opportunity for extreme right-wing teachers to accentuate agitation against Ahmadis. Recently some of these lecturers, apparently guided by leaders of politico-religious parties drafted an application to authorities, and had it signed by the staff members. The application urged the authorities to enforce constitutional and legal provisions against Ahmadis. They have demanded that Ahmadis not use terms like Salam, Insha Allah, Bismillah, etc, and have threatened that, “otherwise…., we can proceed further to safeguard the faith of Muslims”. They have asked for a permanent solution (Mustaqil hal) of the issue.

It is rather fateful that having experienced the impact and consequences of extremists’ policy and practice, the educated section of the society allows itself to be misguided by religious bigots.

Op-eds

It is a said that there are three types of Taliban operating in Pakistan. The Afghan plus non-Afghan ‘foreigners’ attached to Al Qaeda; the Pakistani Taliban who are demanding a change in Pakistan’s foreign policy and enforcement of their tough sharia; and criminals who enrich themselves through jihad.
When the state gets into the business of waging ‘deniable’ jihad with the help of ‘nonstate actors,’ it creates multiple centers of power at the cost of its internal sovereignty. These days, an unhinged war in the form of a ‘reverse’ jihad has engulfed Pakistan. And the only reason why it is raging is the waning of the writ of the state and the empowerment of groups who wish to usurp it.

Pakistan became a frontline state in the war on terror, but the Pukhtun intelligentsia thinks and this conception is shared by many others as well – that its “assets” had to be guarded as well, and hence Swat was made “haven” for some of them.
It is a pity that government of the day, by relying on the crutches of religion, failed to anticipate the outcome of their flawed approach. Sectarianism was inevitable when obscurantists were appeased and given a free rein to preach violence. The need of the hour is that the government cracks down forcefully on banned religious groups before their violence spills into neighbouring states and others compel us to act.

‘MNA promoting violent protest against Ahmadis’

LAHORE: A Pakistan Muslim League-Nawaz (PML-N) member of National Assembly from Layyah has instigated the local people to observe a protest today (Tuesday) against four teenagers and a man belonging to the Ahmadiyya community arrested on the charges of blasphemy, a rights body said on Monday. The accused will be brought before a court today. A press release issued on Monday by the Asian Human Rights Commission (AHRC) stated that some radical groups had announced a show of strength against Ahmadis to pressurise the court not to grant bail to the five Ahmadis. The accused were arrested on January 28 on charges of writing blasphemous comments in a mosque toilet. They were shifted to Dera Ghazi Khan Central Jail, where the fundamentalist groups had asked other inmates to ‘fix up’ the Ahmadis, according to the statement. The commission urged the Punjab government to stop the violent campaign. staff report

5 Ahmadis detained without proof of blasphemy: HRCP

* Report says relative of local MNA, elements belonging to banned organisations pushed police to register case
* Commission demands prompt, transparent investigation into matter

Staff Report

LAHORE: The five Ahmadis detained on the charges of blasphemy in Layyah district have been held without any proof or witness, the Human Rights Commission (HRCP) said on Thursday.

The commission, which had sent a fact-finding team to Layyah district last week, said its findings concluded that an investigation, mandated by law prior to the registration of a blasphemy case, had not been held.

The HRCP team learned that a prayer leader in the village had allowed Ahmadi students from a nearby tuition centre to offer prayers in the mosque. The students were later threatened by a government schoolteacher, and they never went to the mosque again, the commission said. About a week later, some villagers claimed finding blasphemous writings in the mosque’s toilet.

The complainant said in the first information report (FIR), “Since these Ahmadis are the only non-Muslims coming to the mosque, therefore they must have committed the offence.” The argument was heard time and again during the HRCP team’s interviews with the mosque administration, some villagers and the local police. The police and villagers conceded that there were no witnesses or evidence of the Ahmadis’ involvement.

Involvement: The HRCP team found that elements belonging to banned extremist organisations, and that a relative of a member of National Assembly (MNA) from the area had pressured the police to register a case. “It is clear that a local politician has also used his influence” to book the Ahmadis, the commission’s report said.

HRCP said the complainant and his ‘extremist’ supporters were adamant that the Ahmadis should be punished on the basis of presumption.

Investigation: The HRCP demanded a prompt and transparent investigation into the matter to ensure that innocent people were not victimised. It also demanded the government ensure that the Ahmadiyya community in the village was not harassed or ostracised. The commission asked the government to take prompt measures to rule out misuse of the blasphemy law. The detailed fact-finding report can be accessed at the HRCP website: www.hrcp-web.org

Ahmadi children arrested on false charges in Pakistan, alleges Indian Ahmadiyya community

Maqbool Ahmad
Wednesday, 11 February 2009

QUADIAN: Ahmadiyya Muslim community in India spokesman Mohammad Nasim Khan said in a press release that five members of its community residing in Chak 172/TDA, District Layyah, Pakistan have been arrested and charged under Section 295-C of the Pakistani Penal Code. In a grave blow to any standards of decency, four of the accused are children studying at the English language ‘Superior Academy’ private school. Under the terms of Section 295-C any person found guilty is subject to either the death penalty or life imprisonment.

The arrests have been formally condemned by the Asian Human Rights Commission (AHRC) , whilst Asma Jahangir the chairwoman of the Human Rights Commission of Pakistan and Special Rapporteur of the United Nations Commission on Human Rights has also condemned the arrests of the children as ‘heinous’.

The four accused children are Muhammad Irfan, Tahir Imran, Tahir Mahmood and Naseeb Ahmad. There are conflicting reports regarding the exact age of the children however according to both the ‘AHRC’ and ‘The Daily Times’ their ages range between 14 and 16. Mr Mubashar Ahmad, aged 50, has also been arrested under section 295-C. All five were taken into custody on 28 January 2009 by virtue of a police raid on each of their homes. After four hours in custody each of the accused was charged under the terms of section 295-C on the completely false grounds that they had written the name of the Holy Prophet Muhammad (peace be upon him) on the walls of a toilet at the Jamia Gulzar-e-Medina Mosque.

Mr Salim-ud-Din, Spokesperson for the Ahmadiyya Muslim Jamaat in Pakistan said:

“These allegations are completely false and baseless. The police have no evidence whatsoever and have merely succumbed to the pressure of those who spread religious hatred in the region.”

It is of note that none of the persons arrested have any connection to the Gulzar-e-Medina Mosque and they do not live anywhere near it.

The Asian Human Rights Commission has stated:

“Family members were told (by the District Police Officer) that the police were under pressure from fundamentalists to act against the children. If he did not arrest them, the group had threatened to close down the whole city and attack the houses of Ahmadi sect members... The AHRC urges the government of President Asif Zardari to immediately release the illegally detained prisoners.”

The charge laid against the five Ahmadis is completely baseless and false without foundation. The Ahmadiyya Muslim Jamaat reveres the Holy Prophet Muhammad (peace be upon him) as the final law bearing prophet, who brought with him a universal teaching. No disrespect towards him could ever be tolerated by any Ahmadi; man, woman or child. The Founder of the Ahmadiyya Muslim Jamaat, Hadhrat Mirza Ghulam Ahmad wrote:

“The man who in his being and his attributes and his actions and through his spiritual and holy faculties set an example of perfection and was called the perfect man was Muhammad (peace be upon him).”

The Ahmadiyya Muslim Jamaat urges the immediate release of the five persons imprisoned and for all charges to be dropped. In a country which seeks to promote an image of tolerance to the Western world, it speaks volumes that peace loving children have been charged with an offence that sanctions the death penalty as a sentence.

The International Community, Media and Human Rights organisations are all urged to take action to secure the release of all of the accused in this matter. In an era where freedom of religion and belief is accepted as a basic human right throughout the world it is of disbelief that anti-Ahmadiyya legislation is still active and indeed still being so cruelly enforced in Pakistan.

SITUATION IN DISTRICT LAYYAH WORSENS

Qadian 10th Feb (Maqbool Ahmad): Ahmadiyya Muslim Jamat spokesman Mohammad Nasim Khan said in a press release today that the Human Rights situation of its members in District Layyah, Pakistan is worsening. The five Ahmadis, who include four children, arrested on 28 January 2009 remain in police custody. They are not being allowed to meet with any persons, in direct contravention to the provisions laid forth in Article 37 of the Convention on the Rights of the Child to which Pakistan is party.

Further, to the arrests of the five Ahmadis, in the village of Chak 172/TDA the situation is becoming increasingly tense due to the acts of religious extremists in the area. A social boycott against the Ahmadis has started whereby it is not safe for them to travel home via normal routes and they are unable to purchase even food from the local shops.

Inflammatory posters in opposition to the Ahmadiyya Muslim Jamaat are being displayed throughout the village.

Once again the International Community is urged to take immediate action to bring an end to the increasingly dangerous and threatening situation that is developing in District Layyah.

The Ahmadiyya Muslim Jamaat confirms that the situation in District Layyah, Pakistan continues to deteriorate. Although there are elements within the local community who are supportive of the Jamaat, the pressure of the local Mullahs is such that the situation is becoming increasingly tense.

The four children arrested by the authorities on fabricated charges under section 295-C of the Pakistani Penal Code were moved to Dera Ghazi District Jail on 4th February. Even though they have been in custody for over a week they continue to be denied access to Jamaat officials and to their families. An official at the Jail has said that some limited access to family will be granted in the near future, however until such meetings actually occur, doubt remains.

A natural consequence of the continued detention of the children is that they are falling behind in their studies. They are all due to sit exams in one month and therefore are all concerned at their lack of preparation and schooling.

In a further worrying move the local Mullahs have announced that a large scale rally will be held at Chak TDA/172 in opposition to the Ahmadiyya Muslim Jamaat. It is more than likely that this event will be used to incite hatred against the Jamaat and to urge people to act against Ahmadis. The organisers of this event are inviting people from nearby cities such as Dera Isamael Khan and Muzafergarh to take part in this rally. The local authorities and police are seriously concerned about the event which they fear they will be unable to control.

Ahmadi Muslims throughout the world are urged to write to their local media and officials in protest of what is happening in District Layyah.

The International Community is once again urged to take immediate action.
