ISLAMABAD (Rashid Habib): Supreme Court Tuesday adjourned hearing of the petitions challenging various clauses of the 18th Constitutional Amendment till tomorrow.

Chief Justice during the hearing in his remarks said the change in the Objectives Resolution was criminal negligence and Gen. Zia-ul-Haq made forgery in the constitution under RPO. The restoration of the constitution is an achievement by this parliament.

A 17-member larger bench of the Supreme Court resumed hearing of the case this morning.

The Chief Justice remarked that the constitution is a sacred document and no person can forge this document. Zia-ul-Haq made forgery in the constitution under RPO and than assembly surprisingly didnt take notice of it. The words about religious liberties of the minorities were omitted from the constitution under RPO. The lawyer of the Bar Hamid Khan endorsing the remarks of the Chief Justice said than Assembly passed the amendment without taking notice of the omission and thus it had also committed negligence.

Earlier, in his arguments Hamid Khan said the mechanism of judicial commission for appointment of judges has been borrowed from South Africa, which has a presidential system of government.

The Bar counsel in his arguments before the bench said that in UK the Judicial Commission only appoints magistrates and a member of the parliament could not be taken in the judicial commission.

Chief Justice of Pakistan asked whether the Supreme Court has cancelled any amendment in such cases earlier? Hamid Khan said it has not happened earlier, however, the apex court is entitled to review and interprete it.

The Supreme Court adjourned the 18th amendment hearing till tomorrow.

Chief Justice Iftikhar Muhammad Chaudhry said that the Objectives Resolution of 1949 has been misused in the Constitution of 1973.

He said this during today’s hearing of petitions filed against the 18th amendment.

The chief justice said that in the past, parliaments in Pakistan have used legislation to render the Supreme Court’s decisions ineffective. He said the constitution has always been intentionally misused.

Senior lawyer Abdul Hafeez Pirzada sought a copy of the 1973 Constitution from the attorney general during the court proceedings today.

The attorney general assured about the provision of a parliamentary record of debate in the Supreme Court.

The hearing was adjourned till tomorrow.
